Police Reports
Certified copies of police reports can be obtained from the New York State Department of Motor Vehicles once submitted and reviewed by DMV.
Please Note: Under Section 201-I of the Vehicle and Traffic Law, motorist and police reports are only required to be available for four (4) years from the date of loss. Additionally, it can take up to 60 days from the date of loss for police reports to be available through the DMV.
Non-Reportable Accidents: Negative Certificate (198D)
Upon receipt of police and motorist reports, the DMV reviews the accident to make sure it meets the requirements of a reportable accident as follows:
Reportable accidents must show on the report either $1000.00 or more worth of damage or personal injury. If it does not meet either of the criteria, the reports are then destroyed by the DMV.
Should there be no record of a reportable accident or the requested document not be on file with the DMV, it will provide a certified document (negative certificate) stating this fact.
